Automatic collection of information

When you use the Mobile Application, our servers may automatically record information that your device sends. This data may include information such as your device’s IP address, device name and version, operating system type and version, language preferences, access times and dates, and other statistics.

Information collected automatically is used only to identify potential cases of abuse, maintain the security and reliability of the Mobile Application and Services, and establish statistical information regarding usage. This statistical information is not otherwise aggregated in such a way that would identify any particular User of the system.

Collection of personal information

You can access and use certain parts of the Mobile Application and Services without telling us who you are or revealing any information by which someone could identify you as a specific, identifiable individual. However, if you wish to use some of the features offered in the Mobile Application, you may be asked to provide certain Personal Information.

We receive and store any information you knowingly provide to us when you create an account, publish or save content, enter records, use synchronization or backup features, make purchases, or fill any forms in the Mobile Application. When required, this information may include the following:

Some of the information we collect is directly from you through the Mobile Application and Services. We may also receive limited information from service providers, such as cloud service providers, advertising networks, analytics providers, payment processors, app stores, and supported health services, only as necessary to operate the Mobile Application and Services.

You can choose not to provide certain Personal Information, but then you may not be able to take advantage of some features in the Mobile Application. Users who are uncertain about what information is mandatory are welcome to contact us.

Health and fitness data

If you enable the health feature and grant permission, the Mobile Application may read health and fitness data from supported health services, including Health Connect, Samsung Health, Apple Health, or other supported health platforms available on your device.

The health and fitness data we may read or process may include the following:

This data is used only to provide user-facing health and diet management features in the Mobile Application. For example, it may be used to display daily health records, show step counts together with meal records, help you track activity and weight changes, manage hydration records, and support health statistics, trends, and diet management features.

The Mobile Application does not request health data permissions automatically when the app starts. Permission requests are shown only when you enable a health-related feature or tap the permission settings option. You may deny these permissions and continue using the Mobile Application by entering health information manually.

You can revoke or change health data permissions at any time from the Mobile Application’s permission settings, from Health Connect, Samsung Health, Apple Health, or from your device settings, depending on the connected service and operating system.

Health and fitness data may be stored in the Mobile Application, on your device, and, where you use account synchronization, backup, or cloud-based features, on our servers for the purpose of providing the Mobile Application and Services. If you delete your account or delete applicable health records, we will delete or anonymize such data in accordance with this Policy, unless retention is required or permitted by law.

Health and fitness data is not used for advertising or marketing purposes. We do not sell health and fitness data to third parties. We do not share health and fitness data with advertising networks.

Privacy of children

We recognize the need to provide further privacy protections with respect to Personal Information we may collect from children under the age of 13 and take special precautions to protect their privacy. We do not require any Personal Information from children at any time.

If you have reason to believe that a child under the age of 13 has provided Personal Information to us through the Mobile Application and Services, please contact us to request that we delete that child’s Personal Information from our Services.

We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce this Policy by instructing their children never to provide Personal Information through the Mobile Application and Services without their permission.

Use and processing of collected information

We act as a data controller and a data processor when handling Personal Information, unless we have entered into a data processing agreement with you in which case you would be the data controller and we would be the data processor.

Our role may differ depending on the specific situation involving Personal Information. We act in the capacity of a data controller when we ask you to submit Personal Information that is necessary to ensure your access to and use of the Mobile Application and Services. We act in the capacity of a data processor in situations when you submit Personal Information through the Mobile Application and Services and such information is processed only in accordance with your instructions.

In order to make the Mobile Application and Services available to you, or to meet a legal obligation, we may need to collect and use certain Personal Information. Any of the information we collect from you may be used for the following purposes:

Processing your Personal Information depends on how you interact with the Mobile Application and Services, where you are located, and whether one of the following applies: (a) you have given your consent for one or more specific purposes; (b) provision of information is necessary for the performance of this Policy with you or for pre-contractual obligations; (c) processing is necessary for compliance with a legal obligation; (d) processing is related to a task carried out in the public interest or in the exercise of official authority; or (e) processing is necessary for the purposes of legitimate interests pursued by us or by a third party.

For health and fitness data, we rely on your permission and consent. You may withdraw that permission as described in this Policy.

You are able to delete certain Personal Information we have about you. The Personal Information you can delete may change as the Mobile Application and Services change. When you delete Personal Information, we may maintain a copy of unrevised Personal Information for the duration necessary to comply with our legal obligations, resolve disputes, enforce agreements, maintain security, or as otherwise permitted by law.

If you would like to delete your Personal Information or permanently delete your account, you can do so on the settings page of your account in the Mobile Application, where such feature is available, or by contacting us.

You may also delete or change health and fitness records within the Mobile Application where supported, or revoke health data permissions through the Mobile Application’s permission settings, the connected health service, or your device settings.

We do not sell health and fitness data to third parties. We do not share health and fitness data with advertising networks.

Retention of information

We will retain and use your Personal Information for the period necessary as long as your user account remains active, to provide the Mobile Application and Services, to enforce this Policy, to resolve disputes, and unless a longer retention period is required or permitted by law.

We may use aggregated or anonymized data derived from your Personal Information after you update or delete it, but not in a manner that would identify you personally. Once the retention period expires, Personal Information shall be deleted or anonymized.
